Classical international law theory, based on the notion of sovereignty of national states and their territorialization, does not reach juridical relations that take place beyond the territorial circumscription of these states and sometimes are not directly associated with them as subjects. Thus, in the face of new international relations that extrapolate state bounds and borders, and the new actors, subjects of these relations, this work aims to analyze and discuss the effectiveness of the international legal system and the complexity of its relations from the point of view of the theory of transnational legal systems. From a theoretical-reflexive approach, based on critical review of specialized literature, in particular that arising from international studies associated with transnationality. This research aims to rediscuss the notions of general theory of international law and highlight individuals and actors who, although always present in issues related to international law, have remained at the margin of legal relations for a territorial issue. It also aims to give a new look to international governance, not limited to borders and the simple integration of international rules to the normative frameworks of states to cover the breadth of international relations. Studies involving the transnational legal system are complex because they aim to dismantle the state monopoly in regulating and managing transnational conflicts. Under this perspective, the legal system requires breaking imperialist and eurocentric structures to transfer regulation and governance to other international actors in a cooperative and egalitarian system of conflict resolution.
