The social effectiveness of the right to education in the COVID-19 pandemic in Brazil:
how the pandemic negatively impacted it

: Fundamental rights are those that aim to protect and guarantee the dignity of the human person. The second generation of human rights emphasized social rights, including the right to education. The Brazilian Constitution, in its article 6, makes clear the importance that the legislator gave to guaranteeing this right. However, it is known that the effectiveness of this right in factual reality falls short of what is necessary, reiterating the need for research on the subject, as it is a right provided for in the country's maximum legal document. The research proposes to analyze and conceptualize social rights, the effectiveness of the right to education in Brazil before the COVID-19 pandemic and how the pandemic affected this effectiveness. The hypothetical deductive method is used, demonstrating how the social effectiveness of the right to education fell short of desirable during the COVID-19 pandemic in Brazil
