Constitutional aspects of the new art. 492 of the Brazilian Code of Criminal Procedure

Abstract

The Law n. 13,964/2019 brought several changes in the legislation dealing with criminal matters in Brazil. One of them was in art. 492 of the Code of Criminal Procedure. With the new wording, those convicted by the popular trial to a 15 years or more, they must be immediately arrested and begin the early execution of the sentence. Therefore, in the present work, sought to analyze whether the device is compatible with the Constitution. An analysis of the legislative developments and jurisprudence of the Supreme Court on the presumption of innocence. At the end of the article, it was concluded that even if the legal provision is in force, it is incompatible with the principle of the presumption of innocence. Its violation of the Constitution, including, is being evaluated by the Supreme Court currently and has already had general repercussion recognized. We also conclude that this new wording can only be applied to cases that occurred after the law was valid, as it is a material procedural rule. The method adopted was deductive. The technique used was bibliographical research in primary, secondary and tertiary sources.

Graduated in Law from Universidade Paulista (1995) and Master in Law from Pontifical Catholic University of São Paulo (2004). He is currently a visiting professor at the OAB / SP Superior School of Law, master assistant at the University of Mogi das Cruzes, member - Brazilian Bar Association, São Paulo Section and professor at the Pontifical Catholic University of São Paulo, Department III - Criminal, Process Criminal and Legal Medicine. He has experience in the area of Law, with an emphasis on Law, acting mainly on the following topics: dry law, traffic law, jury court, traffic crimes and legal assistance.
