This review presents vote No. 46.057, of Civil Appeal No. 1.007.122-05.2017.8.26.0664 TJ/SP. The case addresses two different situations that merge into the same action, on the one hand an action of adverse possession and on the other the inventory of the same property. The TJ/SP took into account the fact that the heirs proved the right of direct possession of the property. The heirs were considered only the successors of the prospective purchasers. The 4th chamber of the TJ/SP accepted the appeal, giving the heirs the right to regulate the entire property, regardless of the regularization of the inventory.
