Fraternity, a natural attribute of the human being, which is born from the need for communication, gives content to solidarity based on the understanding of the other. Promotes equality based on difference and not statistical parity. The technical criteria of administrative efficiency and effectiveness ignore human dignity in pursuit of statistical results. The research was developed using the hypothetical-deductive approach method, the comparative procedure, the indirect documentation technique, the bibliographic research: in books and legal journals; documentary; legislation and electronic websites.
