Abstract

The Precedent 448 of the TST deals with the maximum degree of unhealthiness observed in the environment of cleaning toilets, since notices a “large circulation of users”. According to the Precedent, the maximum degree of unhealthiness would prevail, regardless of the provisions of the Collective Agreement of the Category or any expert assessment carried out by a union entity, and its relevance to the debate was set aside. Thus, the importance of a analysis according to the CCT rule was excluded, given the imposition of the Precedent. However, there was an internal circumstantial change in the system, since the pressure of this hypothesis of analysis of unhealthiness, according to the definition of the CCT, an occurrence “hanging by exclusion, but still within the system itself”, gave rise to the issue in the STF (Precedent 1.046) that once again called into question the absolute prevalence of the summary understanding. The phenomenon observed is an inverse autopoiesis, since, normally, the change in the system occurs due to frictions in the environment, arising from expectations of other systems. But in this situation, the opposite is observed: the occurrence excluded from the main mechanism, without a function, but from within the system itself, is what pressed its edges, providing shelter for changes in the legal subsystem.

He holds a degree in Law from the State University of Londrina (2002); a specialization in modern and contemporary philosophy - ethical and political aspects from the State University of Londrina (2003); a master's degree in literature from the State University of Londrina (2004); a doctorate in philosophy from the Pontifical Catholic University of Rio Grande do Sul (2007); a post-doctorate in law from the Eurípedes University Center of Marília (2019); and a post-doctorate in law from UNIMAR, Marília, SP (2024). He was chief of staff to the Brazilian Minister of Education in early 2019 and legal advisor to the Roquete Pinto Social Organization. He is a lawyer, having worked in public and private law, mainly in the state of Paraná, in tax and administrative cases, involving civil and labor lawsuits, as well as in the sub-area of ​​public law: administrative improbity. He specializes in analyzing, consulting, and executing judicial and extrajudicial challenges to public bidding processes, as well as requesting and drafting renegotiations and public contract revisions. He served as Attorney General and Legal Advisor for the Municipality of Cornélio Procópio, Paraná; Attorney for the Municipality of Uraí, Paraná; and as a professor at universities in Paraná, teaching Philosophy, Philosophy of Law, Civil Procedure, Tax Law, and Administrative Law. He also taught English at the Minsky Institute, Language School, promoting technical and pedagogical connections between English and other languages, such as French, Italian, and Latin. He has experience in Philosophy, with an emphasis on Medieval Philosophy and Philosophy of Law, particularly in the following topics: conservatism and culturalism, the thought of Mário Ferreira dos Santos, the thought of Leonardo Prota, translations of medieval texts from Latin, and presentations of major themes from the Middle Ages to contemporary times. He was honored with the "Green Gold" Commendation, granted by Law 511/20 by the Municipality of Cornélio Procópio, PR, being an effective advisor to the Center for Contemporary Studies - INSTITUTO MEMÓRIA - starting in December 2019. He served as an advisor to the National Council of Education (CNE - 2020-2024 - DOU 10/07/2020).
