International child abduction in the time of Covid-19

Abstract

Considering the globalization and the pandemic of Covid-19, the research aimed to answer the following question: did the Covid-19 pandemic impact the decisions given in 2020 about the return or not, of the child to habitual residence, regarding the procedure of the 1980 Hague Convention? If so, in what way? For this, descriptive research was carried out with the aid of bibliographic and documentary procedures and the method of quantitative-qualitative approach. The Convention was briefly examined, especially regarding the rule of compulsory return of the child to the habitual residence and its exceptions. It was also verified, among the decisions given in 2020, collected from the International Child Abduction Database (INCADAT), the reasoning of those that determined the return of the child to their habitual residence, as well as those that did not. It was found that only in two out of a total of 16 decisions, the health context had, in fact, an essential role in the decision. In the other cases, there was no impact since the reference to the pandemic merely verified the existence of restrictions on international travel that would prevent immediate return, which did not occur in any case.
