Abstract

We intend, through this article, to outline a comparison between penal law, what was in force in Rome, in many steps and the penal canonic law, displaying the opposite diametrically positions between one another, displaying the evolution of the punishment concept, its base after the scientific progress of the penal science, through the legal medicine, the psychology, disciplines which are also, punishment sciences, because they study the crime and the means of preventing, and to fight against it.
