The catholic occupant of high-ranking public office in light of the Canonical Code

Abstract

The author analyzes the Canon 225, §2nd of the Code of Canon Law of 1983 and demonstrates how the public employee being a catholic can imbue and perfect the temporal orders with the spirit of the Gospel when practicing the so called “discretionary act”. The article is divided in three parts: 1) the role of the layman; 2) the work of the public emplyoee being a catholic, and 3) some hypothetical situations in which the public employee being a catholic can act.

Professor da Faculdade de Direito Canônico São Paulo Apóstolo. Doutor em Direito Canônico pela Pontifícia Universidade Lateranense, de Roma, com a nota máxima da summa cum laude: 90/90. Membro da Sociedade Brasileira de Canonistas (SBC) e do conselho diretor da Academia Marial de Aparecida (AMA). Autor de vários livros, especialmente de “A responsabilidade cristã na administração pública” (Paulus, 2011), baseado em sua tese doutoral.
