Abstract

Interdiction is a way of outlawing specific cases in which the person can no longer answer for their actions, whether civil life and/or assets. This study aims to identify the juridical appeals from 2003 to 2013 involving elderly and interdiction at the Tribunal de Justiça do Rio Grande do Sul (Justice Tribunal of Rio Grande do Sul). This unique instrument should be respected and used with caution, always aiming for the best interests of the elderly and their protection.

Anelise Crippa, Pontifícia Universidade Católica do Rio Grande do Sul (PUCRS).

Advogada. Especialista em Direito Processual Civil e em Direito de Família. Mestre em Gerontologia Biomédica. Doutoranda do Programa de Pós-Graduação em Gerontologia Biomédica da PUCRS. Pesquisadora do Laboratório de Bioética e de Ética Aplicada a Animais da PUCRS.

 

Irenio Gomes, Pontifícia Universidade Católica do Rio Grande do Sul (PUCRS).

Médico neurologista. Pós-Doutor em Neurologia. Professor Adjunto do Programa de Pós-Graduação em Gerontologia Biomédica da PUCRS.
