Abstract

This research establishes a relationship between the theoretical of philosophical hermeneutics of the phenomenological tradition and subjectivity in legal interpretation, proposing a critical reflection on the discretionary power, the subjectivity of the interpreter and the freedom of belief, observing the absence of phenomenological ideals about the role of the judge.

Graduated in Law from José do Rosário Vellano University (2002). Specialization in Constitutional Law from the José do Rosário Vellano University (2005). Specialization in Procedural Law from the Pontifical Catholic University of Minas Gerais (2010). Specialization in Philosophy from the Pontifical Catholic University of Minas Gerais (2015). He has experience and works as a Judicial Support Officer at the Court of Justice of Minas Gerais (TJMG) in the area of Law, with emphasis on civil and tax matters. Master's student in Constitutionalism and Democracy at the Faculty of Law of Southern Minas - FDSM

Post-Doctor in Philosophy and Theory of Law from the Faculty of Law of the University of Coimbra (2011), Doctor of Public Law from Unisinos (2008), Master of Law from UCS (2005) and Law degree from UCS. He is a permanent professor in the Postgraduate Program in Law at the Faculty of Law of Southern Minas-FDSM and a collaborating professor in the Postgraduate Program in Bioethics at the University of Vale do Sapucaí-Univás. Coordinator of the Graduate Program in Law at FDSM. Lead researcher of the Margins of Law Research Group (PPGD / FDSM). Theory, philosophy and sociology of law are his main areas of interest.
