Analysis of the trade union freedom of the caput of Art. 8 of the Constitution of the Federative Republic of Brazil of 1988

Abstract

The present study, based on Prof. João de Lima Teixeira Filho, published in the book Comments to the 1988 Constitution on labor social rights, Coordinators Luciano Martinez and João de Lima Teixeira Filho (arts. 6 to 11): a tribute to the 30 years of the Constitution of the Republic and to the 40 years of the Brazilian Academy of Labor Law, asks whether the caput of art. 8 of the Constitution of the Federative Republic of Brazil allows concluding the existence of freedom of association. Without wanting to exhaust the theme, obviously, adopting the study of Prof. Teixeira Filho, who examines Trade Union Freedom in the Brazilian Constitution, union autonomy, collective union freedom, individual union freedom as a guide for analyzing the hypothesis, now proposed, which was the subject of a seminar in the discipline Constitution and Labor Relations , in the first half of 2022, given by Eminent Jurist and Prof. Gilberto Stürmer, in the Stricto Sensu Graduate Program in Law at the Pontifical Catholic University of Rio Grande do Sul (PPGD-PUCRS). The article by Prof. Teixeira Filho, structured by contextualizing the theme of freedom, addressing the origin of freedom of association to enter into the examination of collective freedom of association, as well as individual union freedom, and also allowing to bring comments on the union contribution and the effects that the labor reform causes and may cause even more in union activity, enabled a brief investigation, which is brought to light in this study to finally make a conclusive comment on the topic addressed, understanding that there is still no effective full union freedom in our legal system.
