Limits of the arbitration clause in consumer contracts

Abstract

This research aims to analyze the viability of arbitration as a dispute resolution mechanism in consumer relations, considering recent legislative changes and Brazilian case law. Focusing on law no. 13129/2015, the study examines the compatibility of the arbitration legal regime with consumer principles, particularly with regard to the competence and jurisdiction of the arbitration court in adhesion contracts. The benefits of arbitration will be examined, such as procedural speed and the specialization of the arbitrator, as well as the challenges inherent to its application in a context marked by consumer vulnerability, with emphasis on the need to ensure effective and adequate judicial protection.

Gleibe Pretti, Universidade Federal de Santa Catarina - UFSC - Florianópolis, SC

Post-Doctorate in Law from UFSC. PhD in the Postgraduate Program in Law at the University of Marília, area of ​​concentration Economic Enterprises, Development and Social Change, with the thesis: Application of arbitration in labor relations, as a form of effectiveness of justice, Master in Geoenvironmental Analysis at Univeritas (UnG). (2017) Post-graduate in Constitutional Law and Labor Law and Process at UNIFIA-UNISEPE (2015). Bachelor of Law from the University of São Francisco (2002), Degree in Sociology from Faculdade Paulista São José (2014), Degree in History (2021) and Degree in Pedagogy (2023) from FAUSP. Judicial Expertise by CONPEJ in 2011 and ABCAD (360h) complementary training in graphotechnical expertise. He is currently a University Professor in the Undergraduate Program at the following faculties: Faculdades Campos Salles (FICS) and UniDrummond. UNITAU (University of Taubaté), as a professor of postgraduate studies in labor law, as well as arbitration, Professor of Jus Expert, in handwriting expertise, document analysis, expertise, evaluator of movable assets and investigator of usucaption. Professor at SEBRAE - for entrepreneurs. Member and researcher of the Research Group on Epistemology of national and international arbitration practice, at the University of Marília.
