Abstract

The recognition of stricto sensu postgraduate diplomas (Master's and Doctorate) obtained from foreign universities is a fundamental procedure for professionals to fully exercise their qualifications in Brazil, whether in academia or in the job market. This process, regulated by Brazilian educational bodies, aims to ensure the equivalence and quality of foreign education in relation to national standards. Among the various requirements demanded for the processing of the recognition request, the proof of the period of stay abroad during the course stands out as a crucial element. This article aims to explore in depth the importance and the means of proving this period, offering a complete overview of the topic. In the context of the globalization of higher education, academic mobility has become increasingly relevant. Consequently, the number of professionals seeking to pursue stricto sensu postgraduate studies (Master's and Doctorate) at foreign universities is growing, aiming to enrich their academic education and broaden their professional prospects. However, for these diplomas to be officially recognized in Brazil, it is necessary for the stay abroad to be duly proven, respecting the regulations established by the Ministry of Education (MEC) and the Coordination for the Improvement of Higher Education Personnel (CAPES). This article addresses the requirements and the importance of proving the period of stay abroad for the recognition of stricto sensu postgraduate diplomas issued by foreign universities (art. 20, paragraph 4, VII of Resolution CNE/CES n. 2 of December 19, 2024), in addition to examining the role of Brazilian institutions in this process.

Post-Doctorate in Law from UFSC. PhD in the Postgraduate Program in Law at the University of Marília, area of ​​concentration Economic Enterprises, Development and Social Change, with the thesis: Application of arbitration in labor relations, as a form of effective justice, Master in Geoenvironmental Analysis from Univeritas (UnG). (2017) Post-graduate in Constitutional Law and Labor Law and Procedure from UNIFIA-UNISEPE (2015). Bachelor of Laws from São Francisco University (2002), Degree in Sociology from Faculdade Paulista São José (2014), Degree in History (2021) and Degree in Pedagogy (2023) from FAUSP. Judicial Expertise by CONPEJ in 2011 and ABCAD (360h) complementary training in handwriting expertise. He is currently a University Professor in the Undergraduate Program at the following universities: Campos Salles College (FICS) and UniDrummond. He also teaches postgraduate courses in labor law and arbitration at UNITAU (University of Taubaté). He also teaches handwriting expertise, document analysis, expert witnessing, personal property appraisal, and investigator of adverse possession. He also teaches at SEBRAE (Brazilian Association of Entrepreneurs). He is a member and researcher of the Research Group on Epistemology of National and International Arbitration Practice at the University of Marília (UNIMAR).

Vanessa da Ana, Docente da Faculdade Anhanguera de Guarulhos, Guarulhos, SP

Lawyer; Forensic Handwriting Expert; Professor at FAUSP; Professor of the Drummond Group's Postgraduate Program. She holds a Master's degree in Science, focusing on Nuclear Law, from IPEN/USP, and a specialization in Civil Law and Civil Procedural Law from Fundação Armando Alvares Penteado. She was Academic Director of the Carlos Drummond de Andrade University Center - Penha Campus; Course Coordinator and Coordinator of the Legal Practice Center at Anhanguera Educacional S/A; Defender of the 5th Disciplinary Panel of the Ethics and Discipline Court; and Member of the Permanent Bar Examination Committee of the OAB/SP. She has experience in Business and Educational Management, Civil Law, Civil Procedural Law, and Constitutional Law.

Anderson Jamil Abrahão, Universidade Nove de Julho, UNINOVE, São Paulo, SP

Master's degree in Economics of Globalization and Development, jointly held by PUC/SP and the University of Paris I - Sorbonne; Specialist in Public Law from the São Paulo School of Magistracy; Bachelor of Laws from Paulista University - UNIP (1997). He is a researcher at the Observatory of Nationalities research network; served as an instructor for the 6th class of the Ethics and Discipline Court of the Brazilian Bar Association - São Paulo Section, as well as a member of the Research and Postgraduate Law Committee of the Brazilian Bar Association - São Paulo Section. He works as a professor at the Andreucci Complex, PROORDEM, and the Central de Concursos (Central Competitions Center); and works as a lawyer in his own law firm. He has experience in Law with emphasis on Public Law, Civil Law and Human Rights, and Economics. He is a PhD student in Law at Nove de Julho University.
