In this work we will analyze the judgment of the Extraordinary Appeal No. 636.331 from the perspective of international law, which evaluated a topic of general repercussion on the application of the Warsaw and Montreal Conventions to the detriment of the Consumer Protection Code, with regard to the limitation of the liability of international air transport companies for lost luggage. Next, we will study the impacts of this understanding on the reimbursement lawsuits filed by insurers against international carriers, as well as the current orientation of the courts on the subject.
