Abstract

The popular jury is one of the most important institutions when it comes to criminal law. Through it, the will of society is expressed, which, weighing the evidence in a manner free from legal thoughts, judges according to the best understanding for society. The constitutional legislator wanted to express that the most serious crime that attacks the community was the one brought to justice by the people, who, having contact with the evidence, expertise and debates in plenary, will decide the outcome of such an accusation.
Even so, due to the rigor that is applied to intentional crimes against life, there is a need in the Criminal Procedure Code to filter the accusations, thus ensuring that the people's judgment is as accurate as possible.
