A judicialização da política ou o rearranjo da democracia liberal

Abstract

This essay analyses how the prepoderance of judicial methods inpolitics leads to new configurations in the organization of legislative,executive and judiciary bodies of government. It discusses also howthe juridical method dominates others spheres of life and how itdevelops reforms in the law apparat, in order to become it lessformal and more permeable by social demands. Besides that, theessay suggests that this asymmetrical arrangement of the threebranches of government reinforces the distrust of democraticprinciples, because they introduce in the system, based onmajoritarian principles, the non-majoritarian methods.
