Reimaginar o entrelaçamento entre dois universais

Resumo

Nas últimas décadas, o estudo do direito e da religião passou por uma considerável reconstrução. Cada vez menos limitado pelas modernas interpretações estatistas do discurso sobre direitos ou ligado a contextos confessionais, o estudo comparativo da intersecção entre direito e religião por antropólogos, historiadores, sociólogos e cientistas da religião vem passando por um verdadeiro renascimento. Novos trabalhos instigantes têm explorado o entrelaçamento entre ideias, instituições e objetos materiais jurídicos e religiosos ao longo de todo o tempo e espaço compreendidos pela história humana. Ao apresentar os debates contemporâneos no âmbito do direito e da religião aos estudiosos de ambos os campos, este artigo estabelece uma relação de compromisso entre o estudo acadêmico da religião e os estudos sociojurídicos. Os debates em questão examinam como e quando as leis de um estado permanecem uma arena significativa de contestação; o papel das elites autóctones e dos arranjos de pluralismo jurídico em contextos coloniais; novas abordagens aos temas da economia, raça, soberania e cidadania. Ao mobilizar uma compreensão do direito que não supõe a existência de um monopólio do Estado sobre a geração e a regulação da normatividade jurídica, este artigo argumenta que manter o direito e a religião em suspenso enquanto tradições normativas convida a uma imaginação muito mais expansiva desses universais na sua singularidade, em copresença e como domínios sobrepostos.
